§ 103.1 Obedience
to officers, signs and signals.
No person shall fail, neglect or refuse to
comply with any order of a member of the State
Police, the collectors at toll booths at interchanges
and barriers, flaggers of the maintenance forces,
and such uniformed officers as may be employed
by the Thruway Authority for such purposes.
No person shall fail, neglect or refuse to
comply with any traffic control sign, signal
or device erected or displayed by the Thruway
Authority on the Thruway system, unless directed
otherwise by a member of the State Police or
Thruway Authority employee.

§ 103.2 Speed
limits.
The maximum speed limit on the Thruway system
is fifty-five miles per hour except:
- from milepost NE-3.54 to milepost NE-15.01, for trucks only, 50 miles per hour;
- as otherwise posted;
- E-Z pass administrative speed enforcement program.
- Speeds. Dedicated lane speed limits will be posted at 5 mph.
- the account holder of any vehicle which passes through a lane at a speed in excess of the posted limit, but less than 30 mph, is subject to a written warning advising that any offenses are subject to suspension as noted below;
- the account of any motorist whose vehicle passes
through a lane at a speed of 30 mph or more is
subject to suspension or revocation; and
- an account holder whose vehicle speeds through a lane will receive written notice advising that suspension/revocation of their E-Z pass account will commence within 10 business days from the date of the notice.
- Offenses. Suspension and revocation will be administered as follows:
- first offense: suspension for up to 60 days;
- second offense: suspension for up to 180 days; and
- third offense: revocation.
- Appeal process. Account holders will be advised that they may appeal or dispute the notice in writing to the authority within 10 business days of the date of the notice. Suspension/revocation will be held in abeyance pending resolution of the appeal.
- The appeal will be reviewed by the authority within five business days of receipt. While it is not necessary for an account holder to appear in person at the appeal, the account holder will be advised of the review date and time if they wish to attend. The account holder will be advised of the decision.
- An additional offense during the appeal process may result in immediate suspension/revocation.
- Account balance and tag deposit for revoked accounts will be returned to the account holder in accordance with the E-Z pass terms and conditions.
- Account holders have the option of closing out their suspended accounts and the account balance and tag deposit will be returned in accordance with the E-Z pass terms and conditions; however, a new account will not be opened until the suspension completion date of the old account.
- General.Notwithstanding these provisions, all motorists are subject to arrest for violation of the New York State Vehicle and Traffic Law or the Thruway's rules and regulations (e.g., reckless driving, speed too fast for conditions, etc.).

§ 103.3 One-way
traffic.
Except as otherwise directed by proper authority,
no person shall operate, or cause to be moved,
any vehicle on the Thruway system except
in the direction of traffic. The driver of
a vehicle entering a service area, interchange,
shoulder, or deceleration lane shall enter
from the right-hand traffic lane. Upon entering
a traffic lane from a service area, interchange
or access ramp, the driver of a vehicle shall
use the acceleration lane and he shall enter
the Thruway with caution so as not to interfere
with or endanger traffic.

§ 103.4 Use of the medial strip.
- Driving a vehicle on or across, or parking, standing or stopping a vehicle on the medial strip is prohibited; provided, however, that these prohibitions shall not apply to:
- police, maintenance or official Thruway Authority vehicles;
- emergency service vehicles operated by oil companies under contract with the Thruway Authority;
- towing trucks and emergency service vehicles operated by garages authorized by the Thruway Authority;
- certified tandem maintenance vehicles provided in the provisions governing tandem trailer operations;
- fire vehicles or ambulances when operated in the performance of their official duties;
- independent contractors' construction vehicles authorized by the Thruway Authority and when supervised;
- emergency services coming to the assistance of a disabled truck or bus when such emergency service vehicle is (i) owned and operated by, or (ii) under contract with the subject company whose vehicle is disabled and provided the crossing or use of the medial strip is necessary for the purpose of towing, repairing or otherwise servicing the disabled vehicles and it is done under the supervision and with the consent of the State Police or an employee of the Thruway Authority;
- disabled vehicles in tow by any emergency service vehicle operating under the conditions set forth in paragraph (7) of this subdivision; or
- any other vehicle duly authorized by the Thruway Authority's executive director or his designee; provided, however, that in all cases, the operator thereof uses caution so as not to interfere with or endanger traffic.
- The prohibition against parking in the medial strip shall not apply if, in the opinion of a member of the State Police, parking on the shoulder is dangerous or impractical under the conditions then existing and provided it will not interfere with maintenance operations.

§ 103.5 No U turns.
A U turn on the Thruway system is prohibited
except when approved and supervised by a member
of the State Police or an employee of the Thruway
Authority. Excepted from the provisions of this
section are such authorized vehicles as are
described under section 103.4 of this Part,
and then only under such conditions as are described
therein.

§ 103.6 Driving,
overtaking and passing.
- Trucks, buses and vehicles hauling trailers are prohibited from using the extreme left lane on the following portions of the Thruway system:
- milepost 0.0 to milepost 45.0 northbound;
- milepost 44.6 to milepost 0.0 southbound;
- milepost 146.9 northbound to milepost 159.5 westbound;
- milepost 158.7 eastbound to milepost 147.3 southbound;
- milepost 420.7 to milepost 428.8 westbound;
- milepost 429.1 to milepost 420.7 eastbound;
- milepost N-0.7 to milepost N-6.5 northbound;
- milepost N-6.5 to milepost N-0.5 southbound;
- milepost NE-3.5 to milepost NE-15.0 northbound; and
- milepost NE-15.0 to milepost NE-3.5 southbound.
- The provisions of subdivision (a) of this section shall not apply where the normal lanes are not available by reason of construction, accident or otherwise.

§ 103.7 Changing
lanes.
A vehicle shall be driven as nearly as practicable
entirely within a single lane and shall not
be moved from such lane until the driver
has first ascertained that such movement
can be made with safety.

§ 103.8 Parking of vehicles.
- Parking is prohibited on all roadways. No vehicle on the Thruway system shall be parked, stopped or allowed to stand on the traffic lanes, acceleration lanes, deceleration lanes, bridges, access ramps or on shoulders in front of service areas.
- Stopping is prohibited on the shoulders of the traffic lanes except in an emergency, or when authorized by the State Police or an employee of the Thruway Authority. In the event that it is necessary for the driver of a truck or tractor trailer to leave such vehicle on the Thruway unattended and it is impossible or impractical, in the opinion of the State Police, to have such vehicle towed off the Thruway, the driver shall obtain a parking permit from the State Police before leaving the Thruway system.

§ 103.9 Accidents.
In addition to the provisions of the Vehicle
and Traffic Law of the State of New York,
the driver of a vehicle involved in an accident
on the controlled system resulting in injury
or death to any person or damage to any property,
real or personal, shall immediately stop
such vehicle at the scene of the accident,
render such assistance as may be needed,
and give his name, address, license and registration
number to the person injured or to the person
sustaining the damage and to a member of
the State Police or to a toll collector at
the nearest toll booth.

§ 103.10 Unauthorized
use, entry and exit; assessment of tolls.
Entry upon or exit from any part of the Thruway
system, except at interchanges or other authorized
places, is prohibited without regard to intent
to evade tolls. Violators shall be assessed
for tolls properly payable in accordance with
the provisions of Part 101 of this Chapter,
where possible, and otherwise on the basis
of information available to the Thruway Authority.
Similarly, vehicles subject to special hauling
permits or other types of permit which use
the Thruway system in violation of this Chapter,
regardless of intent to evade, shall be assessed
the special fees properly payable in accordance
with the provisions of permit procedures as
though a permit had been granted, computed
on the basis of information available to the
Thruway Authority. Assessments herein prescribed
shall be in addition to fines and penalties
otherwise prescribed by law.

§ 103.11 Emergency
lighting equipment.
The provisions of section 375 of the Vehicle
and Traffic Law of the State of New York
shall be applicable. Exceptions contained
therein relating to cities and incorporated
villages shall not be applicable.

§ 103.12 Vehicle
and Traffic Law.
Except for those sections which are inconsistent
with or modified by the sections of this
Part, the provisions of the Vehicle and Traffic
Law of the State of New York shall apply.

§ 103.13 Vehicles
under special hauling permit.
Vehicles, including tandem trailer combinations,
operating on the Thruway system under special
hauling permit shall be required to comply
with all pertinent rules and regulations, as
well as to all additional requirements imposed
by the Thruway Authority as conditions for
the issuance or the continuing validity of
the permit.

§ 103.14 Vehicles
under 40 miles per hour.
Vehicles equipped with simultaneous flashers
shall be required to use them when traveling
on the Thruway at a speed of less than 40 miles
per hour, except when posted for less or when
the flow of traffic dictates otherwise.

§ 103.15 Application
of this Part.
The provisions of this Part, except for section
103.9, shall not be applicable to vehicles
operated by the State Police or by Thruway
Authority personnel authorized by any member
of the Thruway Authority or the Thruway Authority's
executive director, when engaged in the performance
of their duties, the promotion of safety,
the aid of law enforcement and the protection,
help and assistance of users of the Thruway
system.
